CAR TRAVELS VEHICLE RENTAL AGREEMENT

Legally Binding Contract

This Vehicle Rental Agreement (“Agreement”) is a legally binding contract between Car Travels (“Company”) and the individual renting a vehicle (“Renter”). By taking possession of any vehicle owned, leased, or managed by Car Travels, the Renter agrees to comply with every term, condition, restriction, and financial obligation contained in this Agreement.

Violation of any term of this Agreement constitutes breach of contract and authorizes the Company to immediately terminate the rental, disable the vehicle if equipped, repossess the vehicle without notice, charge additional penalties, and pursue legal remedies including collections and arbitration.

2. RENTAL ELIGIBILITY REQUIREMENTS

To rent a vehicle from Car Travels, the Renter shall meet the following requirements:

  1. Renter shall be at least twenty-five (25) years of
  2. Renter shall possess a valid government-issued driver’s
  3. Renter shall provide identity verification upon
  4. Renter shall purchase Company-provided rental insurance at a rate of $20 per
  5. Renter shall comply with all monitoring systems installed in the
  6. Renter shall not operate the vehicle outside the State of
  7. Smoking inside the vehicle is strictly
  8. Pets inside the vehicle are strictly
  9. Only authorized drivers listed in the rental record may operate the vehicle.

Failure to comply with these eligibility requirements constitutes breach of contract.

3.RENTAL TERMS

  1. The rental period begins when the vehicle is delivered or picked up and ends when the vehicle is returned and inspected by the Company.
  2. The vehicle shall be returned on or before the scheduled return
  3. Late returns exceeding one (1) hour shall automatically trigger an additional full rental day
  4. The Renter shall return the vehicle in the same condition as received except for normal wear and
  5. The vehicle shall not be used in any unlawful or negligent

4.PAYMENT TERMS

  1. Rental pricing shall be based on the price paid through the Wheelbase booking
  2. The Renter authorizes Car Travels to charge any payment method provided for:
    • Rental fees
    • Damage charges
    • Penalties
    • Mileage overages
    • Cleaning fees
    • Toll charges
    • Repossession costs
  1. The Renter shall remain financially responsible for all charges incurred during and after the rental

5.SECURITY DEPOSIT TERMS

A security deposit ranging from $250 to $1,000 shall be collected prior to vehicle release.

The security deposit shall secure compliance with this Agreement and cover:

  • damage
  • penalties
  • tolls
  • cleaning
  • repossession
  • mileage overages
  • loss of use

Deposit Forfeiture Triggers

The security deposit shall be fully forfeited under any of the following conditions:

  • driving over 120 MPH
  • unauthorized driver operation
  • smoking inside the vehicle
  • pets inside the vehicle
  • reckless driving
  • mechanical abuse
  • racing or performance driving
  • out-of-state travel
  • disabling GPS monitoring
  • refusing to cooperate in an accident investigation
  • failing to return the vehicle
  • abandonment of the vehicle
  • repossession due to breach of contract
  • fraud or attempted chargeback
  • illegal activity involving the vehicle

The Company reserves the right to charge amounts exceeding the deposit if damages exceed the deposit amount.

6. FEES AND PENALTIES

The Renter agrees to the following mandatory fees and penalties:

  • Cleaning Fee — $200
  • Smoking Fee — $250 to $500
  • Pet Cleaning Fee — $300
  • Reckless Driving Fee — $100 per incident
  • Speeding Over 100 MPH — $100 per occurrence
  • Speeding Over 120 MPH — Automatic deposit forfeiture
  • Unauthorized Driver Fee — Double the daily rental cost
  • Repossession Fee — $150 plus $10 per mile traveled
  • Toll Processing Fee — 50% to 100% surcharge of toll cost
  • Mileage Limit — 150 miles per day Mileage Overage Formula

Mileage beyond the daily limit shall be charged based on the daily rate.

Example: If the renter pays $100 per day with 100 miles included, any additional mileage shall be $1 per mile.

7. INSURANCE AND DAMAGE RESPONSIBILITY

The Renter shall remain financially responsible for all damage occurring during the rental period.

This includes but is not limited to:

  • windshield damage
  • tire damage
  • wheel damage
  • underbody damage
  • interior damage
  • mechanical abuse
  • collision damage
  • vandalism
  • theft damage

Mechanical Abuse Clause

Damage caused by excessive acceleration, racing, drifting, redline driving, or abusive operation shall be considered mechanical abuse, and the Renter shall be responsible for the full repair cost.

Normal wear and tear shall be covered by the Company.

8. ACCIDENT REPORTING AND CLAIMS

If an accident or damage occurs, the Renter shall comply with the following requirements:

  1. Notify Car Travels immediately and no later than 24 hours after the
  2. Obtain a police report for any accident or damage
  3. Provide photographs and written documentation of the
  4. Cooperate fully with the Company and any insurance claim

Failure to provide a police report shall result in full financial liability for the renter.

G.TOTAL LOSS RESPONSIBILITY

If the vehicle is deemed a total loss, the Renter shall be financially responsible for the full market value of the vehicle, plus:

  • loss of use
  • diminished value
  • towing
  • administrative costs

10. LOSS OF USE

If the vehicle becomes unavailable for rental due to damage caused by the Renter, the Renter shall pay loss of use charges calculated based on the vehicle’s daily rental rate.

11. DIMINISHED VALUE

If a vehicle loses resale value due to accident damage, the Renter shall be responsible for diminished value if the insurance carrier does not cover it.

12. PROHIBITED USES

The Renter shall NOT use the vehicle for:

  • racing
  • drifting
  • reckless driving
  • driving outside California
  • towing
  • off-road driving
  • transporting illegal substances
  • transporting animals
  • smoking
  • unauthorized commercial activities
  • allowing unauthorized drivers

Violation of these provisions results in immediate contract termination.

13. VEHICLE MONITORING DISCLOSURE

The Renter acknowledges and agrees that:

  • All vehicles are equipped with GPS tracking devices
  • Speed monitoring systems are active
  • Geofencing prevents vehicles from leaving California

The Company shall monitor vehicle location and driving behavior to enforce contract compliance.

14. DEFAULT AND REPOSSESSION

If the Renter violates this Agreement, Car Travels shall have the immediate right to:

  • remotely disable the vehicle
  • locate the vehicle using GPS
  • Repossess the vehicle without notice

The Renter shall pay all repossession costs, including towing, mileage, recovery agent fees, storage, and administrative expenses.

15. CHARGEBACK AND FRAUD PROTECTION

The Renter agrees not to dispute legitimate charges through their credit card provider. If a chargeback occurs:

  1. Car Travels shall submit this signed agreement, telematics data, rental records, and communications as
  2. The Renter shall remain liable for all disputed
  3. Fraudulent disputes shall result in collections and legal

16. PAYMENT PLAN AND COLLECTIONS

If damages occur, the Company may allow a payment plan not exceeding 30 days.

If payment is not received within 7 days of invoice issuance, the account shall be forwarded to collections.

The Renter shall be responsible for:

  • collection agency fees
  • credit reporting fees
  • legal recovery costs

17. INDEMNIFICATION

The Renter shall indemnify, defend, and hold harmless Car Travels, its owners, employees, and affiliates from any claims, lawsuits, damages, injuries, or liabilities arising from the renter’s operation or possession of the vehicle.

18. LIMITATION OF LIABILITY

Car Travels shall not be liable for any indirect, incidental, or consequential damages, including lost wages, missed work, or travel interruptions.

1G.DISPUTE RESOLUTION – ARBITRATION

All disputes arising under this Agreement shall be resolved exclusively through binding arbitration in the State of California under California arbitration law.

The prevailing party shall recover attorney fees and legal costs.

20. VENUE AND JURISDICTION

All legal proceedings shall occur in the State of California, County of Los Angeles.

21. ELECTRONIC SIGNATURE

Electronic signatures shall have the same legal effect as handwritten signatures.

22.NO WAIVER

Failure by Car Travels to enforce any provision shall not waive the Company’s right to enforce it later.

23. SEVERABILITY

If any provision of this Agreement is deemed unenforceable, the remaining provisions

shall remain fully valid and enforceable.

24.FORCE MAJEURE

Car Travels shall not be liable for delays or failure to perform caused by events beyond reasonable control, including natural disasters, government actions, or system failures.

25. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes all prior discussions or representations.

26.    RENTER ACKNOWLEDGEMENT AND SIGNATURE

By signing below, the Renter acknowledges that they:

  • have read this agreement in full
  • understand all terms and penalties
  • accept full financial responsibility Renter
